The information provided to the traveler in the Program/Offer regarding the main characteristics of the travel services, the price of the trip, the terms of payment or financial guarantees to be provided, the minimum number of participants required for the trip to take place, and the traveler’s right to withdraw from the contract prior to the start of the trip in exchange for an appropriate penalty, shall form an integral part of the Package Travel Contract if ultimately confirmed, and may not be modified unless expressly agreed in writing by both contracting parties. Prior to the execution of the Package Travel Contract, the Organizer shall communicate clearly, comprehensibly, and prominently to the traveler any changes to the pre-contractual information.
These General Conditions shall be incorporated, signed by both contracting parties, into all Package Travel Contracts concerning the current programs/offers contained, where applicable, in the program/brochure, and are binding upon the parties, together with any specific conditions agreed in the contract or contained in the travel documentation.
The conditions of the services arise from the contractual agreement between “ALPHA BOOTIS, S.L.” (Organizer/Retailer), tax ID (NIF) B-87717054, with registered office at c/ Reserva 16 (29130), Alhaurín de la Torre (Málaga), holder of license number AV-MA-01929, and the client _________________________________ with DNI/ID/Passport number ___________________ and address _________________________________________, regarding his/her participation in the 7-day Self-Guided Route Andalusia taking place from ____________ to _____________ (100% on-road), in accordance with the aspects specified in the information sheet and this contract.

The organization of this package tour has been carried out by “ALPHA BOOTIS, S.L.”, hereinafter also referred to as “Triumph Adventure Experience Spain®.”
The package tour shall be deemed to commence on the date and at the place where the services provided by the Organizer begin. To this end, the Organizer shall deliver together with the Offer a digital brochure containing all the information specified on the website www.triumphadventure.es.
By receiving the Offer together with the brochure or the link specifying said information, the client declares that he/she has been informed of all aspects and characteristics of the trip.
The contract shall be deemed perfected once it has been signed by both parties and the client has paid the full established price (in accordance with the payment methods agreed with the travel provider, commercial agency, intermediaries, or others).
The tours organized by Triumph Adventure Experience Spain® may be undertaken either with the client’s own motorcycle or with one of the rental motorcycles belonging to its fleet, except in the case of the “7-day Self-Guided Route Andalusia “ which can only be undertaken with a rental motorcycle and Morocco Tour.

The use of the motorcycle shall be strictly limited to the timetable established in the itinerary of the tour, and the Organizer shall collect the keys to the vehicle at the end of each stage.
Failure to comply with these rules may result in the Organizer’s right to refuse the client’s participation in the tour or to terminate his/her participation during the tour itself, without the right to reimbursement of any amounts paid.
The participant using his/her own motorcycle shall be solely responsible for any and all possible damages resulting from its use. In the case of “own motorcycle,” the consumer must verify the coverage of his/her motorcycle insurance prior to the trip and provide such details to our customer service department.

This will be specified in each booking confirmation. For tours where the rental motorcycle carries a €1,200 deductible (e.g., Red Desert), the client will be offered the option to purchase a Premium insurance package to reduce the deductible to 300€.

The organizer of the package tour is responsible to the traveler for the proper performance of the travel services included in the contract, regardless of whether these services are carried out by themselves or by other providers, and regardless of the right of recourse against the operator responsible for any non-performance or defective performance, or against third parties who contributed to the event that led to compensation, a price reduction, or other obligations. The organizer declares that they assume the functions of organizing and executing the trip.
The traveler has the right to an appropriate price reduction for any period during which there was a lack of conformity, unless the organizer proves that the lack of conformity is attributable to the traveler.
The traveler has the right to receive adequate compensation from the organizer for any damage or loss suffered as a result of any lack of conformity. Compensation will be paid without undue delay.
The traveler will not be entitled to compensation for damages if the organizer proves that the lack of conformity is:
a) Attributable to the traveler.
Triumph Adventure Experience Spain will not be responsible for:

The organizer may charge a reasonable fee for such assistance if the difficulty was caused intentionally or through the traveler’s negligence. This fee will never exceed the actual costs incurred by the organizer or the retailer.
Regarding the scope and/or conditions of compensation payments by the travel service providers included in the package tour, the provisions of international agreements binding on the European Union will apply, in particular the Athens Convention of December 13, 1974, as amended by the London Protocol of November 19, 1976, when applicable, or the Brussels Convention of April 23, 1970, and other current legal provisions.
In the absence of these, and excluding bodily harm or damages caused intentionally or through negligence, compensation shall be limited to three times the total price of the trip.
The activities organized by Triumph Adventure Experience Spain® involve the use of motorcycles, which carry risks and responsibilities for the client as outlined below:

Triumph Adventure Experience Spain® will be responsible for the organization of the trip, providing the client in advance with approximate kilometers of the route and the type of terrain or medium where the routes will take place.
The organizer’s responsibility will, in all cases and regardless of cause, be limited to the price of the trip when:
In all other cases, the Operator shall not be responsible, especially in traffic accidents. On this type of trip, participants are responsible for their own actions, particularly their driving, choice of tour, and skills as a rider, even when following the guide.
All participants in the trip declare that they agree that the owner, organizers, and representatives of Triumph Adventure Experience Spain® are not responsible for their personal safety and that they shall not be individually or jointly liable for any incidents related to participation or normal course of the trip/activity that cause injury, death, or damage to their property, family, or heirs.
Triumph establishes an annual schedule of events (tours/routes). These routes are designed to cover a specific number of kilometers per day. Many of them are intensive routes, sometimes allowing only brief stops, and are especially focused on riding and enjoyment for participants on the road.
It is important to note that during these routes, unforeseen circumstances such as extreme weather, punctures, breakdowns, roadworks, or other events beyond the organizer’s control may require modifications to the route.
All Triumph Adventure Experience Spain® staff are trained to act in case of emergency and have experience conducting tours.
The instructor or guide reserves the right to deny participation to any rider or client who violates traffic laws or proper motorcycle use, stopping the client from starting or continuing the trip on the motorcycle. In such cases, the client may continue the trip using the support vehicle or any other transport method, the cost of which will be borne by the client responsible for the violation.
Triumph Adventure Experience Spain® includes basic travel insurance but recommends purchasing trip cancellation insurance at the time of booking or within the deadlines established by the selected insurance company.
Travel insurance does not cover any expenses related to the motorcycle, its damages, damages to the rider related to it, or damages to third parties.
Regarding personal motorcycle insurance, the client is responsible for arranging it and ensuring it is valid at the time of the trip. (This will be requested by the organizer.)
The cancellation insurance may be issued by Triumph Adventure Experience Spain® at the client’s request according to the terms of each insurance company, or directly by the client on their own account.
At any time prior to the start of the package trip, the traveler may terminate the contract and will be entitled to a refund of the amounts paid, but must compensate the Organizer for the following costs:
In the case of services already provided: the total management fees, plus any cancellation fees that may have occurred, consisting of costs incurred with the various service providers involved in the trip: issued airline or ferry tickets, airport or port taxes, hotels, accommodations, tickets or entrance fees to certain sites, local land, water, or air transport, escort vehicle, transfers and guided tours, proportional guide fees, and other additional services of the trip that may have been provided.
The penalty will consist of the cancellation fees indicated below based on the total trip price and according to the cancellation period:
Time before trip start | Applicable Penalty |
Up to 165 days before departure | €300 (non-refundable) |
165–90 days before departure | 40% of total trip price (including extras) |
89–60 days before departure | 70% of total trip price (including extras) |
59–31 days before departure | 80% of total trip price (including extras) |
30 days or less before departure | 100% of total trip price |
Note: In all cases, penalties apply to the total trip cost, including any extras purchased. It is recommended to purchase travel cancellation insurance to cover unforeseen events.
It is possible to change the date once to participate in another tour or route scheduled in the annual calendar, or transfer the booking to another person, with a service fee of €200 for the reservation change. This option requires prior consultation with Triumph Adventure Experience Spain® and is subject to the event calendar (the organizer is not obliged to approve such requests). Hotel accommodations, meals, and other associated costs may still apply if changes cannot be accommodated.
In this case, the client must notify the organizer by phone and email of their intention “not to travel.” The amount paid for the trip will be recorded as a “voucher” to be used by the client for the indicated trip(s). The organizing company reserves the right to offer this option.
Similarly, the following actions carried out by the client will not give rise to any compensation:
Clients who request it may access additional medical and cancellation insurance beyond what is included in the trip for ______ euros (please consult the Customer Service for the current price).
To purchase this insurance through Triumph Adventure Experience Spain®, it is essential to send a request by email to [email protected] and pay the amount at the time of the request. If purchased directly with each insurance company, it will be according to their established requirements.
Cancellation insurance will only be contracted through Triumph Adventure Experience if the client requests it in writing and pays the corresponding amount. Once contracted, a written confirmation will be sent. If the client does not receive it, they must request it, since without this confirmation the insurance is not considered contracted.
The cancellation guarantee is valid only if contracted according to the conditions established by each insurance company. We cannot guarantee the cancellation coverage if the insurance is purchased under conditions not established by the insurance companies.
The organizer must provide all services as indicated in the informational brochure. If a service cannot be provided, the organizer will seek alternatives to provide the specified services at no additional cost to the client, offering similar services. If the services are of a lower category, the client will be reimbursed the difference.
If the minimum number of travelers is not reached, the organizing company (ALPHA BOOTIS SL) reserves the right to offer the client the option to continue the trip by adding a supplement that covers the minimum organizational costs. It is essential that at least 6 people form the group to offer this alternative. Supplements will be per person and indicated if the minimum is not reached, according to the timelines for communication of this information.
Triumph Adventure Experience Spain® is committed to providing its clients with all the contracted services under the conditions and characteristics stipulated in the program/offer, in accordance with the following:
The consumer has the right to withdraw from the package travel contract:
If withdrawal during the trip is due to an accident or illness that prevents the consumer from continuing the trip, the agency is obliged to provide the necessary assistance. There is no duty to assist when defects occurring during the execution of the contract are exclusively attributable to intentional or negligent conduct of the consumer.
In both cases, all additional costs caused by the withdrawal, particularly repatriation or transfer to the place of origin, are the responsibility of the consumer.
The traveler may transfer the package travel contract to a third party, provided that the transferee meets the conditions applicable to the contract and notifies the Organizer in advance, in a durable medium, at least seven calendar days before the start of the package trip.
Both the transferor and transferee will be jointly liable for any outstanding payments of the trip price, as well as any commissions, surcharges, and additional transfer costs. These costs must be reasonable and in any case will not exceed the costs actually incurred by the Organizer due to the transfer. The Organizer will provide the transferor with proof of any commissions, surcharges, or other additional costs arising from the contract transfer.
When, due to the type of fare, characteristics of the transport used, or the country to be visited, the transfer is impossible, the Organizer and the retailer may oppose it. The Organizer will indicate the transfer option to a person designated by the client along with the corresponding penalty, and if the booking is not transferred, cancellation costs will be indicated.
In all indicated situations, the client must pay cancellation costs according to the restrictive conditions of the services. Certain fares of our trips are non-refundable, such as ferries, non-refundable airline tickets, hotel rates with cancellation fees at the time of booking, port taxes, or certain hotel or organizational costs (these will be communicated to the client before the transfer).
We recommend that the client purchase cancellation insurance at the time of booking or according to the deadlines established by the respective insurance company.
